AGL AIRSOFT \u2013 BOOKING TERMS & CONDITIONS<\/p>\n
These Terms and Conditions apply to bookings and experiences supplied by AGL Airsoft Ltd.<\/p>\n
Please read these Terms carefully before making a booking.<\/p>\n
IMPORTANT BOOKING INFORMATION<\/p>\n
Before booking, please be aware that:<\/p>\n
\u2022 Bookings are made for a specific date and time.<\/p>\n
\u2022 Where AGL Airsoft agrees to move a booking at the customer\u2019s request, a \u00a320 PER PERSON rescheduling fee applies.<\/p>\n
\u2022 A booking may only be rescheduled ONCE at the customer\u2019s request.<\/p>\n
\u2022 Once a booking has been rescheduled, the replacement date and time are final.<\/p>\n
\u2022 If you miss, cancel or cannot attend your rescheduled booking, the booking and payment will ordinarily be lost and you will need to make a new booking at the applicable full price if you wish to attend.<\/p>\n
\u2022 Requests made with less than 48 hours\u2019 notice are not automatically eligible for refund, credit or rescheduling.<\/p>\n
\u2022 No-shows and missed sessions are not automatically entitled to a refund, credit or replacement session.<\/p>\n
\u2022 Where AGL Airsoft chooses to allow a missed booking to be rebooked as a goodwill exception, a \u00a320 PER PERSON rebooking fee may apply.<\/p>\n
\u2022 Customers arriving late may lose part or all of their booked session.<\/p>\n
\u2022 All participants must meet the applicable age requirements and complete any required waiver before participating.<\/p>\n
Nothing in these Terms removes or restricts any statutory consumer rights which cannot lawfully be excluded.<\/p>\n
1. ABOUT THESE TERMS<\/p>\n
1.1 These Terms and Conditions (\u201cTerms\u201d) govern the sale, booking and attendance of any activity, experience, session, private hire, group booking, event or other leisure service provided by AGL Airsoft Ltd (\u201cAGL Airsoft\u201d, \u201cAGL\u201d, \u201cwe\u201d, \u201cus\u201d or \u201cour\u201d).<\/p>\n
Together, these are referred to as an \u201cExperience\u201d.<\/p>\n
1.2 By completing a booking and making payment, you confirm that you have had the opportunity to read these Terms and agree to be bound by the version applicable to your booking at the time it is confirmed.<\/p>\n
1.3 If you make a booking on behalf of other participants, you are responsible for ensuring that your group is made aware of:<\/p>\n
\u2022 the booking conditions;
\n\u2022 age requirements;
\n\u2022 arrival requirements;
\n\u2022 safety requirements;
\n\u2022 waiver requirements; and
\n\u2022 venue rules applicable to the Experience.<\/p>\n
1.4 These Terms operate alongside any applicable:<\/p>\n
\u2022 participation waiver;
\n\u2022 membership terms;
\n\u2022 product-specific conditions;
\n\u2022 promotional conditions;
\n\u2022 venue rules;
\n\u2022 safety notices; and
\n\u2022 Privacy Policy.<\/p>\n
1.5 Nothing in these Terms excludes, restricts or removes any statutory or consumer right which cannot lawfully be excluded or restricted.<\/p>\n
2. COMPANY INFORMATION AND HOW TO CONTACT US<\/p>\n
2.1 AGL Airsoft Ltd is a company registered in England and Wales.<\/p>\n
2.2 For booking enquiries, cancellations, rescheduling requests or other customer enquiries, please contact:<\/p>\n

You may also contact the relevant venue using the telephone number shown on our website or booking confirmation.<\/p>\n
2.3 If we need to contact you regarding your booking, we may use the email address or telephone number supplied when the booking was made.<\/p>\n
2.4 You are responsible for ensuring that the contact information supplied to us is accurate.<\/p>\n
3. BOOKINGS AND CONTRACT FORMATION<\/p>\n
3.1 All bookings are subject to availability and confirmation.<\/p>\n
3.2 Before completing your booking, you are responsible for checking:<\/p>\n
\u2022 the venue;
\n\u2022 Experience selected;
\n\u2022 date;
\n\u2022 start time;
\n\u2022 duration;
\n\u2022 number of participants;
\n\u2022 participant age requirements;
\n\u2022 package selected;
\n\u2022 price; and
\n\u2022 any optional extras.<\/p>\n
3.3 For online bookings, your booking will normally be accepted once:<\/p>\n
\u2022 payment has been successfully processed; and
\n\u2022 you receive a booking confirmation, confirmation page, receipt or confirmation email.<\/p>\n
A contract between you and AGL Airsoft will then come into existence.<\/p>\n
3.4 Bookings made by telephone or in person will be confirmed when AGL Airsoft accepts the booking and any required payment has been made.<\/p>\n
3.5 You should check your confirmation as soon as you receive it.<\/p>\n
If you believe you have entered incorrect information or selected the wrong booking, you should contact us as soon as possible.<\/p>\n
3.6 We cannot guarantee that customer booking errors can be corrected without changing the booking.<\/p>\n
Where correcting an error requires the date or time of the booking to be moved, the rescheduling provisions in these Terms may apply.<\/p>\n
4. PRICES AND PAYMENT<\/p>\n
4.1 Full payment is normally required when a booking is made unless AGL Airsoft expressly agrees otherwise.<\/p>\n
4.2 Private hire, large groups, corporate bookings, parties, events or other special bookings may require:<\/p>\n
\u2022 a deposit;
\n\u2022 staged payments;
\n\u2022 a minimum payment; or
\n\u2022 full payment in advance.<\/p>\n
4.3 Where a deposit or staged payment arrangement applies, any remaining balance must be paid by the deadline communicated to you.<\/p>\n
Failure to pay the outstanding balance by the agreed deadline may result in cancellation of the booking.<\/p>\n
4.4 The price shown when you complete your booking is the price applicable to that booking, subject to any obvious pricing or technical error.<\/p>\n
4.5 Unless stated otherwise, prices shown to consumers include any applicable VAT.<\/p>\n
4.6 Prices may vary depending on:<\/p>\n
\u2022 venue;
\n\u2022 Experience;
\n\u2022 date;
\n\u2022 time;
\n\u2022 duration;
\n\u2022 package;
\n\u2022 group size;
\n\u2022 upgrades;
\n\u2022 optional extras;
\n\u2022 membership benefits;
\n\u2022 promotions; and
\n\u2022 discounts.<\/p>\n
4.7 AGL Airsoft may change prices for future bookings.<\/p>\n
Changes in price will not ordinarily affect a booking which has already been confirmed.<\/p>\n
4.8 If an obvious pricing or technical error occurs, we will contact you as soon as reasonably possible to discuss the appropriate options.<\/p>\n
5. PARTICIPANT NUMBERS<\/p>\n
5.1 Your booking is made for the number of participants selected and paid for.<\/p>\n
5.2 If fewer participants attend than were originally booked, there is no automatic entitlement to:<\/p>\n
\u2022 a partial refund;
\n\u2022 store credit;
\n\u2022 transfer of the unused participant place; or
\n\u2022 a reduction in the booking price.<\/p>\n
This is subject to any rights available under applicable law.<\/p>\n
5.3 Additional participants may only be added subject to:<\/p>\n
\u2022 availability;
\n\u2022 venue capacity;
\n\u2022 age requirements;
\n\u2022 staff approval; and
\n\u2022 payment of the applicable additional price.<\/p>\n
5.4 We cannot guarantee that additional participants can be accommodated on arrival.<\/p>\n
6. RESCHEDULING<\/p>\n
6.1 General Rule<\/p>\n
Bookings reserve capacity for a particular date, time and number of participants.<\/p>\n
A customer does not have an automatic right to move a confirmed booking.<\/p>\n
Any customer-requested rescheduling is subject to these Terms.<\/p>\n
6.2 \u00a320 Per Person Rescheduling Fee<\/p>\n
Where AGL Airsoft agrees to move the date or time of a confirmed booking at the customer\u2019s request, a \u00a320 PER PERSON RESCHEDULING FEE will apply to each participant whose booking is being moved.<\/p>\n
The fee is charged per participant and not per booking.<\/p>\n
For example:<\/p>\n
\u2022 1 participant = \u00a320
\n\u2022 2 participants = \u00a340
\n\u2022 4 participants = \u00a380
\n\u2022 10 participants = \u00a3200<\/p>\n
6.3 The applicable rescheduling fee must normally be paid before the replacement booking is confirmed.<\/p>\n
6.4 ONE RESCHEDULE ONLY<\/p>\n
A booking may only be rescheduled ONCE at the customer\u2019s request.<\/p>\n
Once AGL Airsoft has agreed to reschedule the booking and the replacement date or time has been confirmed, the customer has used their permitted reschedule.<\/p>\n
The replacement booking will then be treated as the final booking date and time.<\/p>\n
There is no automatic right to reschedule that booking again.<\/p>\n
6.5 Missing or Cancelling the Rescheduled Booking<\/p>\n
Where the booking has already been rescheduled once and the customer subsequently:<\/p>\n
\u2022 cannot attend;
\n\u2022 cancels;
\n\u2022 requests another change;
\n\u2022 arrives too late to participate; or
\n\u2022 fails to attend,<\/p>\n
the booking will ordinarily be treated as lost.<\/p>\n
In those circumstances:<\/p>\n
\u2022 the booking cannot ordinarily be rescheduled again;
\n\u2022 the original booking payment will not ordinarily be transferred to another date;
\n\u2022 any \u00a320 per person rescheduling fee already paid will not ordinarily be refunded;
\n\u2022 no automatic store credit will be issued;
\n\u2022 no automatic refund will be issued;
\n\u2022 no further goodwill rebooking under the same booking will ordinarily be available; and
\n\u2022 the customer will normally need to make a completely new booking and pay the applicable booking price in full if they wish to attend on another date.<\/p>\n
This is subject to any statutory rights which cannot lawfully be excluded.<\/p>\n
6.6 Payment of a rescheduling fee does not guarantee availability on the customer\u2019s preferred replacement date or time.<\/p>\n
6.7 Rescheduling remains:<\/p>\n
\u2022 subject to availability;
\n\u2022 subject to venue capacity;
\n\u2022 subject to operational requirements;
\n\u2022 subject to product-specific restrictions; and
\n\u2022 at AGL Airsoft\u2019s discretion.<\/p>\n
6.8 A replacement booking should normally take place within 30 days of the original booking date, unless AGL Airsoft expressly agrees otherwise.<\/p>\n
6.9 The one-reschedule limit applies to the booking and to participants included within that reschedule.<\/p>\n
Customers may not repeatedly move individual participants from the same booking in order to avoid the one-reschedule limit.<\/p>\n
6.10 Where AGL Airsoft itself requires a booking to be moved, the customer will not be charged the \u00a320 per person customer rescheduling fee.<\/p>\n
A change required by AGL Airsoft will also not count as the customer\u2019s permitted one reschedule.<\/p>\n
6.11 AGL Airsoft may choose to waive or reduce a rescheduling fee or make an exception in appropriate circumstances.<\/p>\n
A goodwill exception made on one occasion does not create an entitlement to the same treatment on another booking.<\/p>\n
7. CANCELLATIONS<\/p>\n
7.1 AGL Airsoft Experiences are generally leisure activities supplied for a specific date or period.<\/p>\n
Accordingly, fixed-date leisure bookings do not generally carry the standard 14-day cancellation right which applies to many other online purchases.<\/p>\n
Nothing in this section removes any cancellation right which applies by law in the particular circumstances.<\/p>\n
7.2 If you wish to cancel a booking, you should contact AGL Airsoft as soon as reasonably possible.<\/p>\n
7.3 More Than 48 Hours\u2019 Notice<\/p>\n
Where a cancellation request is received more than 48 hours before the scheduled start time, AGL Airsoft may offer:<\/p>\n
\u2022 store credit;
\n\u2022 rescheduling subject to the \u00a320 per person rescheduling fee;
\n\u2022 another agreed solution; or
\n\u2022 any remedy required by applicable law.<\/p>\n
7.4 Where cancellation-related store credit is issued, it should normally be used for a booking taking place within 30 days of the original booking date, unless AGL Airsoft agrees otherwise.<\/p>\n
7.5 There is no automatic right to a cash refund simply because a customer changes their mind about attending a fixed-date leisure booking.<\/p>\n
7.6 Less Than 48 Hours\u2019 Notice<\/p>\n
Cancellation or rescheduling requests received less than 48 hours before the scheduled start time are not automatically eligible for:<\/p>\n
\u2022 a refund;
\n\u2022 store credit;
\n\u2022 free rescheduling;
\n\u2022 a replacement session; or
\n\u2022 transfer of the original booking value.<\/p>\n
7.7 AGL Airsoft may refuse a request to move a booking where less than 48 hours\u2019 notice has been provided.<\/p>\n
7.8 Where AGL Airsoft nevertheless agrees, as a goodwill exception, to move a booking with less than 48 hours\u2019 notice, the \u00a320 per person rescheduling fee will apply unless AGL Airsoft expressly agrees otherwise.<\/p>\n
7.9 Any such reschedule will count as the customer\u2019s one permitted reschedule.<\/p>\n
The replacement booking will then be final in accordance with Section 6.<\/p>\n
7.10 Any cancellation charge, retention of advance payment or other financial consequence remains subject to applicable consumer law.<\/p>\n
8. NO-SHOWS AND MISSED BOOKINGS<\/p>\n
8.1 A booking may be treated as a no-show where:<\/p>\n
\u2022 the customer or participant fails to attend;
\n\u2022 the customer arrives so late that the Experience can no longer safely or reasonably be provided; or
\n\u2022 a booked participant does not attend and sufficient notice was not given.<\/p>\n
8.2 A no-show is not automatically entitled to:<\/p>\n
\u2022 refund;
\n\u2022 store credit;
\n\u2022 transfer of the original payment;
\n\u2022 replacement Experience; or
\n\u2022 free rescheduling.<\/p>\n
8.3 The original booking will ordinarily be treated as missed.<\/p>\n
If the customer wishes to attend on another date, they would ordinarily need to make and pay for a new booking.<\/p>\n
8.4 Goodwill Rebooking<\/p>\n
Where the booking has not previously been rescheduled, AGL Airsoft may, entirely at its discretion, offer a no-show customer an opportunity to rebook rather than requiring them to purchase a completely new booking at full price.<\/p>\n
Where AGL Airsoft offers this option, a \u00a320 PER PERSON REBOOKING FEE will apply to each participant being rebooked unless AGL Airsoft expressly agrees otherwise.<\/p>\n
8.5 A goodwill rebooking granted under this section counts as the customer\u2019s one permitted reschedule\/rebooking.<\/p>\n
Once the replacement date has been confirmed, it is final.<\/p>\n
8.6 No Further Rescheduling<\/p>\n
Where a booking has already been rescheduled or rebooked once and the customer subsequently misses, cancels or cannot attend the replacement booking:<\/p>\n
\u2022 the booking will ordinarily be treated as lost;
\n\u2022 the original payment will not ordinarily be transferred;
\n\u2022 any rescheduling or rebooking fee already paid will not ordinarily be refunded;
\n\u2022 no automatic store credit will be issued;
\n\u2022 no automatic replacement session will be offered; and
\n\u2022 the customer will normally need to make a new booking at the applicable full price if they wish to attend.<\/p>\n
8.7 Any goodwill rebooking remains subject to availability and does not create an entitlement to similar treatment in the future.<\/p>\n
Nothing in this section affects statutory rights which cannot legally be excluded.<\/p>\n
9. LATENESS<\/p>\n
9.1 Customers must arrive in sufficient time to complete:<\/p>\n
\u2022 check-in;
\n\u2022 waivers;
\n\u2022 safety briefings;
\n\u2022 preparation; and
\n\u2022 any other requirements before the scheduled Experience.<\/p>\n
9.2 Customers arriving late are not automatically entitled to an extension.<\/p>\n
9.3 A late customer\u2019s Experience may still finish at the originally scheduled finishing time.<\/p>\n
Any time lost because of customer lateness may therefore be deducted from the Experience.<\/p>\n
9.4 Where a customer arrives so late that AGL Airsoft cannot safely or reasonably provide the Experience, the booking may be treated as a no-show.<\/p>\n
9.5 Customer lateness does not automatically entitle the customer to:<\/p>\n
\u2022 refund;
\n\u2022 credit;
\n\u2022 an extension;
\n\u2022 replacement participation; or
\n\u2022 free rescheduling.<\/p>\n
10. AGE RESTRICTIONS AND SUPERVISION<\/p>\n
10.1 Participants must normally be at least 8 years old to participate in AGL Airsoft activities.<\/p>\n
Individual Experiences may have additional or different age requirements where clearly stated.<\/p>\n
10.2 Participants under 18 may be required to:<\/p>\n
\u2022 be accompanied by an appropriate responsible adult;
\n\u2022 have appropriate parental or guardian consent;
\n\u2022 comply with additional supervision requirements; and
\n\u2022 have the required participation waiver completed.<\/p>\n
10.3 AGL Airsoft may request reasonable proof of age or identification.<\/p>\n
10.4 Where a participant fails to satisfy a clearly disclosed:<\/p>\n
\u2022 minimum age requirement;
\n\u2022 supervision requirement;
\n\u2022 consent requirement; or
\n\u2022 waiver requirement,<\/p>\n
AGL Airsoft may refuse participation.<\/p>\n
Where the requirement was clearly disclosed before booking and the customer nevertheless failed to comply, there is no automatic entitlement to a refund, credit or replacement booking.<\/p>\n
11. WAIVERS<\/p>\n
11.1 All participants must complete any participation waiver or agreement required by AGL Airsoft before taking part.<\/p>\n
11.2 Completing a booking does not replace the requirement to complete the relevant waiver.<\/p>\n
11.3 A participant who refuses or fails to complete a required waiver may be refused participation.<\/p>\n
11.4 Our participation waiver operates alongside these Terms.<\/p>\n
These Terms principally govern booking, payment, cancellation and rescheduling matters.<\/p>\n
The waiver contains additional provisions regarding:<\/p>\n
\u2022 participation;
\n\u2022 safety;
\n\u2022 risks;
\n\u2022 behaviour;
\n\u2022 equipment; and
\n\u2022 memberships where applicable.<\/p>\n
12. HEALTH AND SUITABILITY<\/p>\n
12.1 Airsoft and related activities can involve:<\/p>\n
\u2022 loud noises;
\n\u2022 impact from BBs;
\n\u2022 physical movement;
\n\u2022 rapid movement;
\n\u2022 running;
\n\u2022 crouching;
\n\u2022 standing;
\n\u2022 low-light environments;
\n\u2022 reaction-based activities; and
\n\u2022 other physical or sensory demands.<\/p>\n
12.2 Customers and participants are responsible for considering whether they are reasonably able to participate safely.<\/p>\n
12.3 Anyone with a:<\/p>\n
\u2022 medical condition;
\n\u2022 injury;
\n\u2022 disability;
\n\u2022 pregnancy;
\n\u2022 heart condition;
\n\u2022 mobility issue;
\n\u2022 sensory sensitivity; or
\n\u2022 other concern affecting safe participation<\/p>\n
should obtain appropriate medical advice where necessary before participating.<\/p>\n
12.4 Relevant information which affects immediate safety should be brought to the attention of AGL Airsoft staff.<\/p>\n
12.5 AGL Airsoft may refuse or stop participation where staff reasonably believe that continuing would create a safety risk.<\/p>\n
Nothing in this section removes any legal duty owed by AGL Airsoft.<\/p>\n
13. SAFETY RULES<\/p>\n
13.1 Airsoft activities involve inherent risks.<\/p>\n
All participants must comply with:<\/p>\n
\u2022 safety briefings;
\n\u2022 venue rules;
\n\u2022 activity-specific rules;
\n\u2022 safety signs;
\n\u2022 equipment instructions; and
\n\u2022 reasonable instructions given by authorised AGL Airsoft staff.<\/p>\n
13.2 All required eye, face and other protective equipment must be worn whenever staff require it.<\/p>\n
13.3 Participants must not deliberately:<\/p>\n
\u2022 remove required safety equipment in an active shooting area;
\n\u2022 misuse an airsoft gun;
\n\u2022 misuse ammunition;
\n\u2022 tamper with equipment;
\n\u2022 deliberately damage targets or venue equipment;
\n\u2022 enter restricted areas;
\n\u2022 deliberately shoot at staff, spectators or non-participants; or
\n\u2022 behave in a way which creates an unreasonable safety risk.<\/p>\n
13.4 Failure to comply with safety requirements may result in participation being stopped.<\/p>\n
14. BEHAVIOUR AND REFUSAL OF PARTICIPATION<\/p>\n
14.1 Customers and participants must behave responsibly and respectfully towards:<\/p>\n
\u2022 staff;
\n\u2022 other participants;
\n\u2022 customers;
\n\u2022 spectators;
\n\u2022 visitors; and
\n\u2022 venue property.<\/p>\n
14.2 AGL Airsoft may refuse entry, suspend participation or require a person to leave where staff reasonably believe that person:<\/p>\n
\u2022 presents a safety risk;
\n\u2022 refuses to follow safety instructions;
\n\u2022 behaves dangerously or recklessly;
\n\u2022 behaves in a threatening, abusive or violent manner;
\n\u2022 deliberately damages property;
\n\u2022 seriously disrupts other customers;
\n\u2022 misuses equipment;
\n\u2022 appears intoxicated to an extent that creates a safety concern; or
\n\u2022 otherwise seriously breaches venue rules.<\/p>\n
14.3 Where participation is refused or ended because of the customer\u2019s own serious misconduct, intoxication or safety breach, the customer will not ordinarily be entitled to:<\/p>\n
\u2022 refund;
\n\u2022 credit; or
\n\u2022 replacement participation,<\/p>\n
subject to applicable law.<\/p>\n
15. ALCOHOL AND DRUGS<\/p>\n
15.1 Participants must not participate while impaired by:<\/p>\n
\u2022 alcohol;
\n\u2022 illegal drugs;
\n\u2022 misused medication; or
\n\u2022 another intoxicating substance<\/p>\n
where that impairment could affect their ability to participate safely.<\/p>\n
15.2 AGL Airsoft may refuse or stop participation where staff reasonably believe a participant\u2019s condition creates a safety risk.<\/p>\n
15.3 Where participation is refused because of the participant\u2019s own intoxication or impairment, the customer will not ordinarily be entitled to a refund, credit or replacement booking, subject to applicable law.<\/p>\n
16. CHANGES OR CANCELLATIONS BY AGL AIRSOFT<\/p>\n
16.1 AGL Airsoft may occasionally need to:<\/p>\n
\u2022 delay;
\n\u2022 alter;
\n\u2022 move;
\n\u2022 reschedule;
\n\u2022 substitute; or
\n\u2022 cancel<\/p>\n
an Experience.<\/p>\n
16.2 Reasons may include:<\/p>\n
\u2022 equipment failure;
\n\u2022 technical faults;
\n\u2022 maintenance;
\n\u2022 staffing issues;
\n\u2022 health and safety concerns;
\n\u2022 emergencies;
\n\u2022 venue closure;
\n\u2022 power or internet failure;
\n\u2022 severe weather; or
\n\u2022 circumstances outside our reasonable control.<\/p>\n
16.3 Where possible, we will make reasonable efforts to notify affected customers using the contact details supplied with the booking.<\/p>\n
16.4 The \u00a320 per person rescheduling fee will not apply where AGL Airsoft itself requires the booking to be moved.<\/p>\n
A move required by AGL Airsoft will also not count as the customer\u2019s permitted one reschedule.<\/p>\n
16.5 Where AGL Airsoft cancels an Experience and cannot provide the contracted service, we will provide an appropriate remedy in accordance with applicable law.<\/p>\n
Depending on the circumstances, this may include:<\/p>\n
\u2022 an alternative date;
\n\u2022 an equivalent Experience;
\n\u2022 store credit; or
\n\u2022 a refund of sums paid for the service which cannot be provided.<\/p>\n
16.6 Nothing in this section limits a customer\u2019s statutory remedies where AGL Airsoft fails to provide the contracted service.<\/p>\n
17. CUSTOMER-OWNED EQUIPMENT<\/p>\n
17.1 Personal airsoft guns, magazines, gas, BBs, protective equipment or other equipment may only be used where permitted by AGL Airsoft.<\/p>\n
17.2 Personal equipment may be inspected or tested where reasonably necessary for safety or compliance purposes.<\/p>\n
17.3 Equipment must comply with:<\/p>\n
\u2022 applicable law;
\n\u2022 AGL Airsoft FPS limits;
\n\u2022 venue rules;
\n\u2022 safety requirements; and
\n\u2022 staff instructions.<\/p>\n
17.4 AGL Airsoft may refuse the use of equipment which appears:<\/p>\n
\u2022 unsafe;
\n\u2022 damaged;
\n\u2022 unsuitable;
\n\u2022 prohibited;
\n\u2022 non-compliant; or
\n\u2022 improperly modified.<\/p>\n
17.5 Customers remain responsible for their own personal equipment.<\/p>\n
18. DAMAGE TO AGL AIRSOFT PROPERTY<\/p>\n
18.1 Customers must treat AGL Airsoft equipment, facilities and property responsibly.<\/p>\n
18.2 Customers are not responsible for:<\/p>\n
\u2022 normal wear and tear;
\n\u2022 ordinary equipment failure; or
\n\u2022 damage they did not cause.<\/p>\n
18.3 AGL Airsoft may seek reasonable repair or replacement costs where property or equipment is damaged as a direct result of:<\/p>\n
\u2022 deliberate damage;
\n\u2022 vandalism;
\n\u2022 reckless behaviour;
\n\u2022 negligent misuse;
\n\u2022 tampering;
\n\u2022 unauthorised modification; or
\n\u2022 serious failure to follow staff instructions.<\/p>\n
18.4 Any amount sought will take account of the circumstances and reasonable repair or replacement cost.<\/p>\n
19. PERSONAL BELONGINGS<\/p>\n
19.1 Customers are responsible for taking reasonable care of their own personal belongings.<\/p>\n
This includes:<\/p>\n
\u2022 phones;
\n\u2022 bags;
\n\u2022 clothing;
\n\u2022 money;
\n\u2022 jewellery;
\n\u2022 electronics;
\n\u2022 personal airsoft equipment; and
\n\u2022 other valuables.<\/p>\n
19.2 AGL Airsoft is not responsible for loss or damage caused solely by a customer\u2019s failure to take reasonable care of their belongings.<\/p>\n
19.3 Nothing in this section excludes or restricts liability where doing so would be unlawful.<\/p>\n
20. GIFT VOUCHERS AND CREDIT<\/p>\n
20.1 Gift cards, vouchers and promotional credit may have separate conditions disclosed when purchased or issued.<\/p>\n
20.2 Unless a different period is clearly stated, AGL Airsoft gift cards and vouchers are normally valid for 12 months from the date of issue.<\/p>\n
20.3 Gift cards, vouchers and promotional credit cannot normally be exchanged for cash.<\/p>\n
20.4 Lost, stolen or expired vouchers may not be replaceable.<\/p>\n
20.5 Store credit issued in connection with a cancelled booking may have a shorter validity period.<\/p>\n
Where no different period is expressly agreed, cancellation-related credit should normally be used for a booking taking place within 30 days of the original booking date.<\/p>\n
20.6 Nothing in this section removes any statutory consumer right applicable to the particular purchase.<\/p>\n
21. DISCOUNTS AND PROMOTIONS<\/p>\n
21.1 Discounts, promotional codes, membership benefits and special offers are subject to their advertised conditions.<\/p>\n
21.2 Discounts must normally be claimed at the time of booking.<\/p>\n
21.3 AGL Airsoft is not required to apply discounts retrospectively unless:<\/p>\n
\u2022 we agree to do so; or
\n\u2022 applicable law requires otherwise.<\/p>\n
21.4 Proof of eligibility may be required for eligibility-based discounts.<\/p>\n
21.5 If satisfactory proof of eligibility cannot be provided where required, AGL Airsoft may:<\/p>\n
\u2022 refuse the discount; or
\n\u2022 require payment of the difference between the discounted and normal price.<\/p>\n
22. MEMBERSHIP BOOKINGS<\/p>\n
22.1 Separate AGL Airsoft membership terms may apply to customers who purchase or use a membership.<\/p>\n
22.2 Unless a particular membership benefit expressly states otherwise, membership does not override our normal:<\/p>\n
\u2022 booking conditions;
\n\u2022 cancellation policy;
\n\u2022 \u00a320 per person rescheduling\/rebooking fee;
\n\u2022 one-reschedule-only policy;
\n\u2022 lateness policy;
\n\u2022 no-show policy;
\n\u2022 safety rules; or
\n\u2022 product restrictions.<\/p>\n
23. PHOTOGRAPHY AND VIDEO<\/p>\n
23.1 Photography or video recording may take place at AGL Airsoft venues.<\/p>\n
23.2 Customers may incidentally appear in:<\/p>\n
\u2022 photographs;
\n\u2022 other customers\u2019 recordings;
\n\u2022 general venue footage; or
\n\u2022 CCTV.<\/p>\n
23.3 Simply booking or attending an AGL Airsoft Experience does not automatically constitute consent for AGL Airsoft to use an identifiable photograph or recording of you for marketing purposes where consent is the legal basis required for that use.<\/p>\n
23.4 Where separate consent is appropriate for marketing or promotional use, that consent may be requested separately.<\/p>\n
23.5 Customers must not photograph or record:<\/p>\n
\u2022 restricted areas;
\n\u2022 staff-only areas;
\n\u2022 private information; or
\n\u2022 other people in circumstances where doing so would unlawfully interfere with their privacy.<\/p>\n
24. CCTV AND SECURITY<\/p>\n
24.1 CCTV may operate at AGL Airsoft venues for purposes including:<\/p>\n
\u2022 safety;
\n\u2022 security;
\n\u2022 crime prevention;
\n\u2022 staff protection;
\n\u2022 customer protection;
\n\u2022 incident investigation; and
\n\u2022 dispute resolution.<\/p>\n
24.2 CCTV footage may be reviewed where reasonably required in connection with:<\/p>\n
\u2022 an incident;
\n\u2022 complaint;
\n\u2022 safety investigation;
\n\u2022 theft;
\n\u2022 damage;
\n\u2022 chargeback;
\n\u2022 payment dispute; or
\n\u2022 legal matter.<\/p>\n
24.3 CCTV and other personal information will be handled in accordance with applicable data-protection law.<\/p>\n
25. DATA PROTECTION<\/p>\n
25.1 AGL Airsoft may process personal information relating to:<\/p>\n
\u2022 bookings;
\n\u2022 payments;
\n\u2022 attendance;
\n\u2022 customer enquiries;
\n\u2022 waivers;
\n\u2022 memberships;
\n\u2022 incidents;
\n\u2022 complaints;
\n\u2022 safety;
\n\u2022 security; and
\n\u2022 dispute resolution.<\/p>\n
25.2 Personal information will be handled in accordance with applicable data-protection law, including the UK GDPR and Data Protection Act 2018, and our Privacy Policy.<\/p>\n
25.3 Marketing communications will be handled in accordance with applicable privacy and electronic-marketing requirements.<\/p>\n
25.4 Our Privacy Policy is available on the AGL Airsoft website.<\/p>\n
26. LIABILITY<\/p>\n
26.1 AGL Airsoft will provide its services with the reasonable care and skill required by applicable law.<\/p>\n
26.2 Nothing in these Terms excludes or restricts liability where doing so would be unlawful.<\/p>\n
In particular, nothing in these Terms excludes or restricts liability for:<\/p>\n
\u2022 death or personal injury caused by negligence;
\n\u2022 fraud;
\n\u2022 fraudulent misrepresentation; or
\n\u2022 any other liability which cannot lawfully be excluded or restricted.<\/p>\n
26.3 Subject to applicable law, AGL Airsoft will not be responsible for loss caused solely by:<\/p>\n
\u2022 a customer\u2019s failure to follow staff instructions;
\n\u2022 deliberate misuse of equipment;
\n\u2022 unsafe customer behaviour;
\n\u2022 customer lateness;
\n\u2022 a no-show;
\n\u2022 failure to satisfy clearly disclosed participation requirements;
\n\u2022 damage caused by the customer\u2019s own actions; or
\n\u2022 loss which AGL Airsoft did not cause.<\/p>\n
26.4 Nothing in these Terms removes or restricts any right or remedy available under the Consumer Rights Act 2015 or other applicable consumer legislation.<\/p>\n
27. THIRD-PARTY BOOKINGS<\/p>\n
27.1 Where an Experience is purchased through an authorised third-party booking platform, voucher provider or reseller, additional terms relating to that platform or voucher may apply.<\/p>\n
27.2 Customers should review any applicable third-party conditions before purchasing.<\/p>\n
27.3 Nothing in a third-party arrangement removes any statutory consumer right.<\/p>\n
27.4 Where a booking amendment, refund or other transaction must technically be processed through the original platform, the customer may be required to deal with that platform.<\/p>\n
28. COMPLAINTS<\/p>\n
28.1 If there is a problem with your Experience, please notify a member of staff as soon as reasonably possible.<\/p>\n
28.2 Giving AGL Airsoft an opportunity to investigate and address a problem while you are at the venue may make it easier for us to resolve the matter.<\/p>\n
28.3 Complaints may also be submitted to:<\/p>\n
aglcontactus@agl-airsoft.co.uk<\/p>\n
28.4 Nothing in this complaints procedure prevents a customer from exercising any statutory right or remedy available to them.<\/p>\n
29. EVENTS OUTSIDE OUR CONTROL<\/p>\n
29.1 Circumstances may occasionally arise outside AGL Airsoft\u2019s reasonable control.<\/p>\n
Examples include:<\/p>\n
\u2022 severe weather;
\n\u2022 fire;
\n\u2022 flooding;
\n\u2022 major power failure;
\n\u2022 major internet or technical failure;
\n\u2022 emergency incidents;
\n\u2022 government restrictions;
\n\u2022 security incidents;
\n\u2022 significant transport disruption; or
\n\u2022 other exceptional events.<\/p>\n
29.2 Where such circumstances affect a booking, AGL Airsoft will take reasonable steps to reduce disruption.<\/p>\n
29.3 Depending on the circumstances and applicable law, we may offer:<\/p>\n
\u2022 another time;
\n\u2022 another date;
\n\u2022 an alternative Experience;
\n\u2022 store credit; or
\n\u2022 a refund.<\/p>\n
29.4 Nothing in this section permits AGL Airsoft to retain payment where doing so would be unlawful.<\/p>\n
30. CHANGES TO THESE TERMS<\/p>\n
30.1 AGL Airsoft may update these Terms from time to time for future bookings.<\/p>\n
30.2 The version of the Terms applicable when your booking is confirmed will normally continue to apply to that booking.<\/p>\n
30.3 A later version will not retrospectively impose a new fee, restriction or other material obligation on an existing confirmed booking unless:<\/p>\n
\u2022 the customer agrees;
\n\u2022 the original contract lawfully permits the change; or
\n\u2022 the change is required or permitted by law.<\/p>\n
31. SEVERABILITY<\/p>\n
31.1 If any provision of these Terms is found by a court or competent authority to be unlawful, unfair, invalid or unenforceable, that provision will be treated as modified or removed only to the extent necessary.<\/p>\n
31.2 The remainder of these Terms will continue to apply where legally possible.<\/p>\n
32. FAILURE TO ENFORCE A TERM<\/p>\n
32.1 If AGL Airsoft does not enforce a provision on one occasion, this does not automatically mean that AGL Airsoft has permanently waived its right to rely on that provision in the future.<\/p>\n
32.2 Any enforcement remains subject to applicable law and the circumstances of the relevant booking.<\/p>\n
33. TRANSFER OF BOOKINGS<\/p>\n
33.1 AGL Airsoft may approve reasonable booking-name changes where appropriate.<\/p>\n
33.2 A booking cannot be transferred where doing so would breach:<\/p>\n
\u2022 age restrictions;
\n\u2022 membership restrictions;
\n\u2022 eligibility requirements;
\n\u2022 safety requirements; or
\n\u2022 product-specific conditions.<\/p>\n
33.3 Changing the name of a participant does not reset:<\/p>\n
\u2022 a previous reschedule;
\n\u2022 the one-reschedule limit;
\n\u2022 a rescheduling fee already incurred; or
\n\u2022 another condition already applying to the booking.<\/p>\n
34. GOVERNING LAW AND COURTS<\/p>\n
34.1 These Terms are governed by the laws of England and Wales.<\/p>\n
34.2 Proceedings may be brought in the courts of England and Wales.<\/p>\n
Customers living in Scotland or Northern Ireland may also have rights to bring proceedings in the courts applicable to where they live.<\/p>\n
34.3 Nothing in this section restricts any mandatory consumer right relating to jurisdiction.<\/p>\n
35. ACCEPTANCE OF THESE TERMS<\/p>\n
By completing your booking and making payment, you confirm that:<\/p>\n
\u2022 you have had the opportunity to read these Terms before purchasing;<\/p>\n
\u2022 you understand that your booking is for a specific date and time;<\/p>\n
\u2022 you agree to be bound by the applicable Terms;<\/p>\n
\u2022 you understand that where AGL Airsoft agrees to move your booking at your request, a \u00a320 PER PERSON rescheduling fee applies;<\/p>\n
\u2022 you understand that your booking may only be rescheduled ONCE at your request;<\/p>\n
\u2022 you understand that once your booking has been rescheduled, the replacement date and time are final and there is no automatic right to move the booking again;<\/p>\n
\u2022 you understand that if you miss, cancel or cannot attend your rescheduled booking, the booking and payment will ordinarily be lost and you may be required to purchase a completely new booking at full price;<\/p>\n
\u2022 you understand that any \u00a320 per person rescheduling\/rebooking fee already paid will not ordinarily be refunded if the replacement booking is subsequently missed;<\/p>\n
\u2022 you understand that requests received with less than 48 hours\u2019 notice are not automatically entitled to refund, credit or rescheduling;<\/p>\n
\u2022 you understand that a missed session or no-show does not automatically entitle you to a refund, credit or replacement session;<\/p>\n
\u2022 you understand that where AGL Airsoft chooses to offer a goodwill replacement booking following a no-show, a \u00a320 PER PERSON rebooking fee may apply;<\/p>\n
\u2022 you understand that a goodwill rebooking counts as your one permitted reschedule\/rebooking;<\/p>\n
\u2022 you understand that late arrival may reduce or prevent participation;<\/p>\n
\u2022 you accept responsibility for checking your booking information before paying;<\/p>\n
\u2022 you accept responsibility for making your group aware of relevant booking and safety requirements;<\/p>\n
\u2022 all participants will complete any required waiver before participating; and<\/p>\n
\u2022 you understand that nothing in these Terms removes your statutory consumer rights.<\/p>\n
